Marlow Planning Board -- December 12, 2006 - Unapproved minutes of meeting

Present: Ray Despres, Greg Farquhar (representative from Selectmen), Joe Feuer, Lyle Handy, Sr., Bonnie Hazelton, and Michael Puschaver

Absent: Carla Kirsh

The meeting was called to order at 7:05. The minutes from November 14, 2006 were read and unanimously approved as typed.

PUBLIC HEARING:

The Planning Board Chairman read the proposed definitions and amendments and then opened the meeting to comments and discussion from members of the public in attendance. Mary Blank informed the board that the NH Planning and Land Use Regulation book already offers a clear definition of Impact Fees (RSA 674:21V). As discussion followed, it was also pointed out that the “in order for a municipality to adopt an impact fee ordinance, it must have enacted a capital improvements program...” (RSA 674:21V.(b)) At that point, the Planning Board determined to set aside discussion and proposal of the definition and amendment related to impact fees, until such time as the Marlow Selectmen or other appointed committee develops the appropriate capital improvements program.

Then followed a discussion by members of the public and the Planning Board in regard to the other proposed definitions and amendments. Since the board could not agree on a clear definition for large scale residential development, it was finally set aside along with the amendment, for later consideration.

The board then determined to move ahead with the proposed definition and amendment in regard to large scale retail development, only. The Marlow Planning Board proposes the following:

Add the following definition to Article II, Section 202 (inserted alphabetically):

Large Scale Retail Development:

Any retail store(s) whether located in a single building or combination of buildings which exceed(s) 12,000 square feet.  

Add Paragraph 408.6:

Notwithstanding any other provisions contained herein, the establishment of any large scale retail development (as defined) is expressly forbidden in any zone in Marlow.

Other Business

Following the Public Hearing, the Planning Board discussed a situation involving someone who wanted a building permit in order to build a home on a Class VI road. The law does allow a town to waive the ordinance against that plan, however, the planning board unanimously agreed that we would uphold the ordinance.

The meeting was adjourned at 8:20 p.m. The next regular meeting of the Marlow Planning Board will be on Tuesday, January 9, 2007 at 7:00 p.m.
