Marlow Planning Board -- June 14, 2005 / Unapproved minutes of meeting

Present: Ray Despres, Trish Rogan, Carla Kirsh, Joseph Feuer, and Bonnie Hazelton

The meeting was called to order at 7:10. The minutes from May 10, 2005 were read and unanimously approved.

Old Business:

Mr. Feuer reported that the Marlow Selectmen have moved forward with plans for the Cell Tower to be constructed on Marlow Hill. Representatives from Cellular One will be coming before the Planning Board and the Zoning Board of Adjustment in the near future.

Emile Piterak was present, with a copy of the most recent draft of the Zoning Ordinance book The board discussed possible titles for the book, since other information will be included, besides the zoning ordinances. Mr. Piterak explained that eventually the entire book will be available on the town’s web page, thus making it accessible to anyone who wants to download it. The draft was given to Ms. Kirsh for her review, with the understanding that she will pass it on to others on the planning board, so that everyone has a chance to review it before the next meeting.

New Business:

Jeannette Duhaime, Realtor, and Jeff Plaisted were present to discuss a piece of property that Mr. Plaisted is in the process of purchasing. The majority of the property is located in Alstead, but also includes one acre of land in Marlow. Mr. Plaisted wishes to build his home on the one acre in Marlow, but the deed for the property (specifically the one acre in Marlow) includes the statement, “This property will not constitute a buildable lot.” The statement had been added back in October, 1988, when the Marlow Planning Board had granted a boundary line adjustment on said property. At that time the acre of land was transferred from Joe Marks to Gallup and Hall. Ms. Duhaime and Mr. Plaisted had previously met with their attorney and attorney for the seller, who interpreted the wording as just a safeguard against having two homes on the lot. Ms. Duhaime and Mr. Plaisted asked that the Planning Board sign a waiver that they’d developed “clarifying” the statement and thus allowing Mr. Plaisted to build on the one acre in Marlow . However, after a thorough review of the Planning Board’s minutes from 1988, and a phone call to Joe Marks, it was determined that the statement in the deed did constitute a lawful prohibition of any home being built on that part of the property. It was a clear stipulation in the sale agreement. The Planning Board suggested that Mr. Plaisted consider building his home on the Alstead part of the lot.

The next regular meeting of the Marlow Planning Board will be on Tuesday, July 12, 2005, at 7:00 p.m.
