Marlow Planning Board - January 11, 2005 / Unapproved minutes of meeting

Present: Joseph Feuer, Trish Rogan, Deb Monte, Bonnie Hazelton, and Ray Despres

Absent: Carl McConnell and Deborah Washburn

The meeting was called to order at 7:10. The minutes from December 14, 2004 were read and unanimously approved as typed.

Public Hearing

Several members of the town were present for the public hearing to discuss the proposed Articles designed to improve animal control and animal care in Marlow, as well as to remove outdated language and bring Marlow’s code into conformity with current practice. Based on the discussion and response from those present, it was determined to go ahead and add the following 3 articles to Marlow’s warrant. (They will be voted on at the election of officers.)

Article 2 -- To see if the Town will vote to amend the Marlow Zoning Ordinance, as adopted in March 1986, Section 405 Residential -- 5(R-5) District, paragraph 405.2 Permitted uses: by adding an item X. “Kennels”. Said item X shall also become a permitted use in the subsequent zoning districts.

Article 3 -- To see if the Town will vote to amend the Marlow Zoning Ordinance, as adopted in March 1986, Article II. Definitions, Section 202 Term Definitions, by inserting in proper alphabetical sequence: “Kennel: The housing or possession of five (5) or more dogs beyond three (3) months of age. The animals must be licensed and the facility or premises is subject to initial and subsequent periodic inspections by the Animal Control Officer to insure compliance with relevant provision of the Federal Animal Welfare Act.

Article 4 -- To see if the Town will vote to amend the Marlow Zoning Ordinance, as adopted in March 1986, by deleting subparagraphs 5a and 5b in their entirety and inserting as new subparagraph 5a: “A state approved septic system is required for any building that will have running water. An Approval for Construction certificate for such system, issued by the NH Department of Environmental Services, must be on record and numerically identified on the building permit application.”: and inserting as new subparagraph 5b: “An Approval for Operation Certificate for such septic system, issued by the NH Department of Environmental Services, must be received before the Town will issue a Certificate ate of Occupancy. Notwithstanding the above, nothing in this section shall be construed to deny or eliminate the use of alternate systems of human waste disposal which pose no risk to the community or the environment.”

Old Business

Travis Royce of Landmark Land Services was present with the mylar and copies of the map showing a property line adjustment on two pieces of property on Rte. 10, presently owned by Gil Bailey. Since the Marlow Planning Board had reviewed the maps and determined there was no problem with the plans during the December meeting, the Chairman and Secretary signed the mylar and accepted the necessary copies.

New Business

Harlen Maguire was present to discuss his proposed plans to purchase the property on Old Newport Rd. (presently the site of Marlow’s Café and a residence). He hopes to purchase an adjoining piece of property (which fronts Rte. 10), presently owned by the town of Marlow, and build one large structure housing 30 storage units of various sizes, on one section of the property. The residence would remain, and the Café building would remain, but may be changed to a chainsaw store. Discussion followed and the Planning Board determined that Mr. Maguire’s plans were within the acceptable guidelines of that particular zone in Marlow.

The meeting was adjourned at 8:35 p.m. The next regular meeting of the Marlow Planning Board will be on Tuesday, February 8, 2005, at 7:00 p.m.
